Appellant through Mr. S. Sikdar, the Ld. Advocate and Respondent through Mr. Deb Narayan Roy, the Ld. Advocate are present.  Heard both of them at length.  Perused the impugned order and other written submissions.  Seen the original bill filed by the Respondent.  It appears that necessary payment of Rs. 394/- has already been made on 07.09.2007 through Bethuadahari Post Office.  The Ld. Advocate for the Appellant also agrees that necessary payment has already been made by the O.P. but there was a communication gap, as a result of which the outgoing facility of the telephone line in question stands withdrawn till todate.  We are satisfied that necessary payment has been made by the Respondent within the due date and as such we direct the Appellant to restore the outgoing facility of the telephone line forthwith.  We are also satisfied that the Respondent suffered from mental agony and harassment for no fault of his own.  As a result we are inclined to award a compensation of Rs. 5,000/- to be paid to the Respondent within 30 days from today otherwise interest @ 10% p.a. shall accrue on the decretal amount from the date of filing of the complaint before the Forum below till its realization.  Appeal thus succeeds in part.  It is accordingly ordered that be appeal be dismissed in part on contest without cost.  Forum’s order stands affirmed with the aforesaid modification.
