                                J u d g e m e n t.

        The  present disputes emerges out of the complaint petition filed by the above named complainant alleging deficiency in service  against  afore mentioned O.Ps for non refund of  deposited amount a sum of  Rs..11,694/- towards  health insurance.  The brief  facts of the case has summarised here under. 

          That the complainant  is having S.B. account No. 054501000004708 with the bank of O.P. and the  O.P.  is having their insurance i.e. Health Care INS and the O.P is also an agent of the said insurance in addition to his own work. The O.P. has deducted a sum of Rs.5,847/- in the month of January, 2016 and being asked  he stated  that the   policy documents will be received  against the said deposit but till date  there is no such intimation  about  the policy condition. Again the O.P. has  deducted a further sum of Rs. 5,487/- on Dt.19.8.2016.  But till  date the complainant has not received the policy document. Hence this case. The complainant prays the forum direct the O.Ps to refund  the deposited amounts a sum  of Rs.11,694/- with interest  and such other relief as the hon’ble forum deems fit and proper for the best interest of justice.

          On being noticed the O.P filed written version through their learned counsel and contended that  the averments made by the complainant in the complaint may be  considered to have been rebutted and denied unless specifically admitted herein after. The O.Ps taking other grounds in the written version   sought to dismiss the complaint as it is not maintainable  under the C.P. Act, 1986.  It is therefore prayed the forum to dismiss the complaint petition against the O.P. with exemplary costs.

 

The O.Ps appeared and filed their written version.  Heard arguments from the  learned counsel for  the   O.P. and complainant.    Perused the record, documents, written version  filed by the parties. 

Both the  parties     advanced arguments vehemently touching the points both on the facts  as well as on  law.

                                                FINDINGS.

On perusal of the  record it is revealed that  the complainant is having S.B.  account bearing  No. 054501000004708  in the O.P.(Bank ).

On perusal of the  record it is revealed that  the  O.P. in their written version  clearly  contended that the hon’ble Forum has got no territorial jurisdiction to entertain the above complaint  petition   and also to hear the same since the complainant is  the resident of Laxmipur, Dist: Koraput.

Section 11(2)©  of the C.P. Act, 1986 has made  it specific that a complaint shall be instituted in a District Forum with in the local limits of whose jurisdiction  the cause of action, wholly or in part, arises. The present case in hand it is  revealed that  the  complainant is having S.B.  account bearing  No. 054501000004708  in the O.P.(Bank )  at  Laximpur  which is comes under the purview  of the territorial jurisdiction  of the Dist. Consumer Forum, at Koraput, State: Odisha..  For redressal  of   grievance the complainant should file  the above case  before the Koraput District Consumer Forum where the cause of action arose  and she can agitate her grievance for its redressal .      In  view of the above discussion   this forum  dismissed the complaint petition. We  do not  think  proper to go  into merit of this case.  The complainant have no fate other then dismiss.

Further the complaint petition is bad for non joinder of necessary party  i.e. Universal Sompo General  Insurance Co. has not been added as the party  in the present case.

So  to meet the  ends of justice    the following order is passed.

ORDER.

            In  resultant  the complaint petition is hereby  stands  dismissed. The complainant  is free to approach the court of competent  having  its jurisdiction.   Parties are left to bear their own cost.  Accordingly the case  is closed.
