Parties file hazira. The case record is taken up for hearing of the petition dated 15.01.2019 filed by the O.P. no. 3 & 4. Perused the said petition and the case record along with case record of Complaint Case  No. 286/2017. Heard Ld. Lawyers of both sides. Considered.

By filing the present petition O.P. no. 3 & 4 have prayed for dismissal of the complaint against them on the ground that the present case is not maintainable as against them. It appears from the petition of complaint of Complaint Case No. 286/2017 that there is no allegation at all regarding deficiency in service as against these two O.P. nos. 3 & 4 and no relief has at all been prayed for against O.P. no. 3 & 4. It is not understood at all as to why these two O.P. nos. 3 & 4 have been made party in this case. It is therefore held that the complainant has no consumer dispute against O.P. no. 3 & 4 and as such O.P. no. 3 & 4 are unnecessary party and their names should be struck off from the cause title of the petition of complaint.

Hence,

            it is,

that the petition dated 15.01.2019 filed by O.P. no. 3 & 4 is allowed on contest. Let the names of O.P. no. 3 & 4 be struck off from the cause title of the petition of complaint. M.A. Case No. 9/2019 is accordingly disposed of.
