This order is arising out of the M.A. being No. 34/2018 filed by the complainant in the C. C. No. 51/2018 praying for addition of party as OP No. 7 in the cause title of complaint.

It is stated by the complainant that the present complaint is filed against the six numbers of Ops and now the complainant is willing to insert “Burdwan Municipality, represented by its Authorized Person” as OP No. 7 in the cause title of complaint to proceed this case. The complainant further stated that the said amendment does not change the nature and character of this complaint and if this M.A. is not allowed the complainant will be seriously prejudiced.

Heard the ld. Advocate from the complainant. No objection is raised against the petition from the side of the Ops.

At the time of writing this order it is seen that the complainant filed this application to insert “Burdwan Municipality, represented by its Authorized Person” as OP-7. Except this there is nothing written in the schedule. We are of the opinion that the complainant has not supplied the proper address of the OP whom the complainant wants to incorporate as OP-7. We are of the view that the complainant has filed this M.A. with insufficient address for which we are not in a position to allow this M.A. because for sending the notice proper address and sufficient address is necessary, otherwise the notice will return unserved and purpose of complainant will not serve.

Hence, it is

O r d e r e d

that the M.A. being No. 34/2018 be and the same is dismissed on contest without any cost. The complainant is at liberty to file the same afresh with proper and sufficient address within 15 days from the date of passing of this order.

Let plain copies of this order be supplied to the parties free of cost as per provisions of law.
