D/hr. files an application praying for withdrawal of the case on the ground stated therein. Ld. Advocate appearing for the J/dr. endorsed his ‘no objection’ on the said petition.

The said petition for withdrawal of the case by the D/hr. is taken up at the instance of the parties and ld. Advocates of both sides candidly submit that let necessary order be passed for withdrawal of the case.

Having Hd. the both sides and going through the materials on record and specially prayer for withdrawal on behalf of the D/hr., this forum will not stand as hindrance before the parties and as such the permission is accorded to the D/hr. to withdrawal of the case. Of course, liberty is not given to the D/hr. to file a fresh execution case by the self-same cause of action.
