Today is fixed for argument hearing, but the Ld. Advocate appearing for the Complainant ‘not pressed’ the Complaint by making necessary endorsement in the margin of the Complaint.

It is submitted by him that due to some technical errors he not presses the Complaint and he is inclined to withdraw this case with liberty to sue afresh, otherwise grave injustice may be cause to his client. Such being the position the record is taken off from the stage of argument hearing and prayer of Ld. Advocate of the Complainant stands allowed.

Hence, the case be and the same is dismissed as withdrawal with liberty to sue afresh within 30 days hence.

A copy of this order be handed over to the Ld. Advocate.

As the petition of complaint is not admitted the complainant is at liberty to get return the copy of the complaint and other related documents as filed at the time of filing this complaint. For this purpose the complainant has to furnish a separate application before the appropriate authority of this Ld. Commission. The appropriate authority of this Ld. Commission is hereby directed to take immediate step so that the complainant can get return all the aforementioned without any further delay.

Let plain copy be given to the parties free of cost as per CPR.
