The Complainant is present in person by filing hazira

O.P. is also present through his Advocate.

The case is fixed for argument. After hearing arguments from both sides the Commission proceeds to dispose of the case as hereunder: -

The Complainant’s case is that she made an order to the O.P. for making a Divan at a cost of Rs.33,000/- and she got delivery of the Divan on 19/10/2020 by payment of Rs.29,500/- on condition that the Complainant will pay the balance amount of Rs.3,500/- after completion of the incomplete works to the Divan. The Complainant faced a lot of trouble to use the said Divan due to incomplete works but the O.P. did not respond to fulfill the condition and as such the Complainant has approached this Commission for appropriate relief.

The O.P. contested the case by filing a written version denying the material allegation made in the Complaint and prayed for dismissal of the case.

 -: Decision with reasons: -

Having regard to the facts of the case, contention and submission and documents on both sides the Commission finds that the Complainant got delivery of the Divan made by the O.P. by payment of Rs.29,500/- keeping balance of Rs.3,500/- to complete the remaining works necessary for proper use of the Divan.

At the time of hearing both parties were present and on interaction with the parties and the Ld. Lawyer for the O.P. the Commission could ascertain that the O.P. is ready to complete all the repairing works of the Divan after replacement of the old set up to make it fit for use subject to payment of the balance money of Rs.3,500/-.

Both parties have agreed to the mutual settlement / arrangement without going into the controversy as to the defects of the Divan supplied to the Complainant. The Commission also endorses the settlement in the interest of substantial justice.

Accordingly the case is disposed of.

Hence it is ordered……..

That the O.P. will carry out all the repair works including replacement of defective portion of the Divan within a fortnight to the satisfaction of the Complainant on spot payment of Rs.3,500/- by the Complainant to the O.P.

Both parties be supplied copy of this order free of cost.
