None appear for the appellant. Mr. S. Saha, learned counsel, for the respondent has filed the written argument on 26-07-2024. On the other hand, there is no written argument filed by the counsel for the appellant. On 18-06-2024, the counsel for the appellant was absent and last chance was given to the counsel for the appellant to file the written argument fixing 26-07-2024. On 16-05-2024, none was present whereafter matter was fixed on 18-06-2024 for filing of written argument by the parties. On 26-07-2024, as here in above stated the counsel for the appellant was also absent. Though the written argument for the respondent is on record, however this appeal cannot be decided on merit due to absence of the counsel for the appellant nor the written argument is placed on record by the appellant for disposal of the appeal. In view of the same, we are of the considered opinion that the appellant has lost interest in pursuing the case. Accordingly, this appeal stands dismissed for default. Interim order if any stands vacated. Send back the LCR.
