ORDER NO.7 DATED 28.07.2014

Ld. Advocate for the Appellant is present. The delay condonation petition of the Appellant is taken up for hearing. Ld. Advocate for the Appellant submits mainly that the appeal has been made ready on 13.01.2014, but for free copy of the order was inadvertently attached at that time and for taking out of the certified copy of the order, there has been delay, and thereafter the appeal has been filed. As such, it took about 73 days delay in addition to the statutory period. Upon considering the materials on record, there has been delay still on 13.01.2014. There is also no ground as to why the certified copy could not be attached at that time. Ignorance cannot be taken as an exception. There is hardly any merit in the petition. Sufficient cause is absolutely absent.

Accordingly, the delay condonation petition of the Appellant stands rejected. Consequently, the appeal fails and is dismissed being barred by limitation.
