Final Order / Judgement

This C.C. is coming on before us for final hearing; complainant appeared in person; opposite party called absent; upon perusing the material papers on record and upon hearing and having stood over for consideration, this Forum passed the following order;

 

O  R  D  E  R

          This complaint is filed u/s.12-A of Consumer Protection Act, 1986. 

 

2.      The averments made in the complaint are that the complainant is a retired employee, as he retired from his service he transferred his gas connection from Madhira HP Gas Agency to Rajahmundry HP Gas Agency.  At the time of transfer the gas connection the opposite party collected Rs.100/- towards transfer charges and also collected Rs.222/-  from the complainant saying that the amount will be adjusted  to the  account of the complainant towards subsidy.  The complainant further submitted that the above amount of Rs.222/- will be deposited by the transferee agency at the time of issuance of connection, which the complainant have been going to transfer.  The complainant further submitted that the Maruti Agency, Rajahmundry refused the above and stated that after deposit of the entire amount only they can issue gas connection, for that the complainant informed the same through letter to the opposite party but the oppositeparty failed to give reply.  The complainant further submitted that due to non issuance of gas connection he and his family members are suffering mentally, for that he filed the present complaint.

 

  1. On behalf of the complainant the following documents were filed and marked as Ex.A-1 to A-4.

 

Ex.A-1:- Letter addressed by the complainant to the opposite party.

Ex.A-2:- Photocopy  of Courier Receipt.

Ex.A-3:- Photocopy of Reply given by the opposite party dt.20-09-2016.

 

Ex.A-4:- Photocopy of SV/TV/CTA Form, dt. 02-08-2016.

 

4.      On receipt of notice, the opposite party failed to appear before this Forum.

 

5.      Upon perusing the material papers on record, now the point that arose for consideration is,

 

           Whether there is any deficiency of service on the part of opposite party?

 

Point :-

The facts of the case are that the complainant is a retired employee, transferred his LPG Gas connection from HP Gas Agencies Madhira, Khammam District to Maruthi Gas Agencies, Rajahmundry for that he paid transfer charges and also Rs.222/- towards subsidy which is said to have been deposited by the Government.  According to the complainant the above amount of Rs.222/- will be adjusted by the transferee agency, which the complainant has been going to transfer.  According to the complainant the Maruthi Agency Rajahmundry refused the above and stated that after depositing the entire amount only they can issue gas connection, for that the complainant addressed a letter to the opposite party but the opposite party failed to give reply.  According to the complainant due to non-issuance of gas connection he and his family members are suffering physically and mentally for that he approached the Forum for redressal.

 

To support his case, the complainant filed documents along with complaint.  From the documents available on record, we observed that as per exhibit A-4 reply letter issued by opposite party dt.20-09-2016,  at the time of transfer as per rules they have collected Rs.50/- towards documentation charges from the complainant.  And also opposite party submitted that for the amount of Rs.222.81/-, they have mentioned the same on SV/TV/CTA Form as per the instructions of HPCL and for the proof they have also issued photocopy and they have not collected any excess amount. 

 

From the documents, we observed that the opposite party collected the charges from the complainant as per rules and regulations of the HPCL and there is no case and there is no negligence on the part of opposite party.  In view of the aforesaid reasons, the complaint is liable to be dismissed.

 

6.      In the result, the complaint is dismissed.  No costs.
