Order Below Exh. 01 In C.C.No. 1175/2009

Complaint and his advocate are absent since long.  The matter has been pending for the evidence of the complaint since 15/02/2011.  The complaint has not taken any step for leading his additional evidence nor has closed his own.   It appears that complaint is not interested in prosecuting the matter.  As such we had passed an order against compliant on last date on 19/08/2013 that he shall take step, else matter would be dismissed default. Today also neither complaint not his advocate is present.  No step taken by the complaint.  The matter is therefore liable to be dismissed in default vide section 13 (2) (C) of the Consumer Protection Act, 1986.  Hence we pass the following order.

O R D E R

1. The complaint is dismissed in default vide Section 13 (2) (C) of the Consumer Protection Act, 1986.
  
2. Inform the parties accordingly.
