ORDER

           Complainant is present. Record is fixed for admission point.

             This case has been filed by Ram Naresh Prasad and Smt. Uma Devi jointly against the O.P. M/s Pahi Constructions Pvt. Ltd. through Director.

           It is claimed that the complainant paid RS. 1,00,000/- for booking amount of his flat in the project of the O.P. on 18.08.2011 through cheque. The money receipt was handed over to the complainant. On 27.06.2012 complainant requested to the O.P. for cancellation of the booked flat because the project for construction of the flat was not started even after 10 months of booking.

               A legal notice was issued on 2015 but there was no reply. Again a legal notice was issued in 2018 and 2019 but there was no reply. From the above fact, it appears that period of filing of the complaint is beyond 2 years from the date of cause of action on 27.06.2012 arose. Therefore, this complaint is time barred and cannot be entertained at this Forum.

              Therefore, this case is not maintainable as being time barred, hence it is dismissed.
