SRI A. K. RAY, MEMBER.

Heard Mr. N. R. Mukherjee, the Ld. Advocate appearing for the Revisionist who has come to us in revision against the order dated 19.01.2010 passed by the Forum below.  Mr. Mukherjee argued that they wanted to file W.V. before the Forum below, but it was not allowed.  On a careful perusal of the impugned order it appears that the Ld. Forum passed the order in question after hearing both the parties at length on the issue involved.  The O.P. appearing before the Forum below on that particular date did not make any prayer for filing any W.V. after correcting or amending the earlier order of the Forum wherein it was ordered that the O.P. did not file any W.V. and as such the next date was fixed for hearing of arguments.  Even the application filed by the O.P. did not contain any prayer for a liberty to file Written Version.  We, therefore, feel that the order appears to be innocuous and there is no material to hold that the said order suffers from any irregularity or illegality.  The revision petition, therefore, cannot be accepted as it stands.  The same is accordingly dismissed.  We, however, do not make any other order in respect of filing Brief of Written Argument before the Forum below.
