Ld. Advocate for the Complainant is found present. O.P is found absent on repeated calls till 1:20 p.m. The petition filed by the Complainant being M.A. No. 162/2023 is heard, considered and allowed. The Complainant filed the photocopy of the death certificate of O.P No. 2 named Dilip Deb. The date of death is 19/12/2022 as per death certificate. The photocopy of the death certificate is kept with the record.

As per direction O.P No. 2 Dilip Deb died leaving behind legal heirs namely Uma Deb (wife), Debojyoti Deb (Son) and Moumita Deb (Daughter).

The O.P No. 2 expunged from the complaint and substituted the said heirs in the steps by O.P No. 2. The substituted petition filed by the Complainant under order 22 rule 4 is considered and accepted.

The Complainant is directed to file amended complaint within the statutory period.

By allowing this amendment petition the contents of the complaint is not changing in any manner.

Fixing by 03/10/2023 for filing amended complaint.
