Final Order / Judgement | Order NO: 9 Today is fixed for hearing. The appellant is being represented through Ld. Advocate Mr. C. Chakraborty. The respondent Rakesh Saharan is present personally and his case is being conducted by his Ld. Advocate AK Singh and others. One joint petition is filed from the end of both sides of the appeal where it is submitted before the Commission that both parties has settled the dispute amicably and out of such settlement, the respondent Rakesh Saharan has already received 3,71,990/- by bankers’ cheque. And the cheque amount has already encased and for that reason there is no necessity to proceed with the appeal as because out of such settlement the award of Ld. Forum has been duly complied with. Accordingly, the appeal case is hereby disposed of is terms of their compromise petition which is presented today before this Commission. And this petition to be treated as part of the appellate order passed by this Commission today. One further application is filed by the appellant who prays for refund the statutory deposit rupees 25,000/-. The petition of moved by the Ld. Advocate S. Chakraborty and in support of his petition he produces a copy of order of Kolkata Bench of Hon’ble SCDRC, WB. Accordingly, the appellant is entitled to refund the statutory deposit as per provision of Law and rule and the Registrar of the Commission would take necessary action. Let a copy of this order be delivered to the parties of the appeal free of cost and also the order to be communicated to Ld. DCDRF, Siliguri as well as to the Registrar of WBSCDRC, Kolkata through E-mail. | |
