From the track report it is obvious that service of notice upon all the OPs save and except OP no. 1 and OP no. 6 could duly be effected. But none of them has entered appearance so far. No W/V has been filed by them as yet. As the statutory period for filing W/V being over the case as against those OPs will proceed ex parte.

The Ld. Advocate of the complainant who is present submits that OP no. 1 has already passed away. From the record it is transparent that OP no. 1 and OP no. 6 are same and identical person. The Ld. Advocate files an application for substitution of the legal heirs of Raju Ghosh. The said application is registered as MA/241/2022 and taken up for hearing. After hearing the Ld. Advocate and perusing the aforesaid MA, we think that the prayer of the complainant should be allowed for the ends of justice. The said MA/241/2022 is thus disposed of.

The Ld. Advocate of the complainant is directed to file amended complaint incorporating the names of the legal heirs of Raju Ghosh and also to issue notice to the legal heirs of Raju Ghosh fixing 06.01.2023 for S/r and appearance and asking them to file W/V within 30 days from the date of receipt of the notice.

As such, 06.01.2023 is fixed for S/r and appearance and also for filing amended complaint.
