Final Order / Judgement

         Heard Mr. U. Sarma, learned counsel, appearing for the petitioner in the condonation petition. Mr. S. Bhattacharjee has entered appearance on behalf of respondent nos. 1 and 2. Notice to the respondent no. 3 has been returned after due service as it is evident from the acknowledgment card and as such, notice upon the respondent no. 3 shall also be deemed to have been completed.

          This is an application for condonation of delay of 44 days in preferring the connected appeal. We have perused the application and explanation given therein and we find that the explanation are satisfactory. Accordingly, the delay of 44 days is hereby condoned.

          Misc Case stands disposed. In view of the order passed in this Misc Case, Registry shall allot a number to the pending appeal and the same shall be listed for admission on 5-5-2014.

          We have also heard the parties on the interim prayer. Mr. S. Bhattachrjee has objected that if at all an interim order is to be passed, the same may be subject to condition of deposit of 50% of the awarded amount. For the time being and till the returnable date, the impugned order dated 30-9-2013 passed by the District Forum, Cachar, in C.C. No. 67/2011 shall not be acted upon. Prayer of Mr. Bhattacharjee shall be considered on the date of admission.

          Later on, Mr. U. Dutta appears on behalf of respondent no. 3.
