Heard Ms. S. S. Chakraborty, learned counsel appearing for the appellant. Also heard Mr. J. Singh, learned Sr. counsel assisted by Ms. K. Agarwal appearing for the respondent. As Mr. Singh has already entered appearance, there is no need for issuing notice to the respondent and he has fairly submitted that the petition for condonation of delay can be taken up for disposal.

               This is an application for condonation of delay of 74 days in preferring the connected appeal. We have perused the explanation given in para 4, 5 of the petition. Opportunity was given go Mr. Singh whether he would like to oppose the prayer for condonation of delay but Mr. Singh submits that he will not be filing any objection to the prayer for condonation of delay. In view of the submission made by Mr. Singh and also the explanation given in the condonation petition, the delay of 74 days is hereby condoned.

               Misc Case stands disposed. In view of the order passed today in the Misc Case, Registry shall allot a number to the pending appeal and the same shall be listed for admission on 29/10/2013.

               We have also heard on the prayer for interim order. Appellant has able to make out a case for an interim order. Accordingly, the impugned judgment dated 7/6/2013 passed by the District Forum, Golaghat, in C.P. Case No. 6/09 shall nt be acted upon until further order.
