ORDER

Today is fixed for passing order. Accordingly record is taken up    for passing order. No other document has been filed by

complainant. The President is present through on line virtual   hearing.

 

                                      This commission has considered submissions of the complainant on previous date and has also perused the documents filed.

 

                             The complainant has drawn attention that he is one of the partner of Usha Tea House of the address mentioned in the cause title. The opposite parties are also the partners of GREEN RICK tea Pvt. Ltd as alleged. The complainant has paid a amount of Rs.49,10,760/- to the Ops for his business of tea but the Ops. have not return the said amount yet, so necessary steps should be taken to solve the matter by directing to return the amount and also to pay for mental pain and agony, costs of litigation etc.

 

                             From the document filed by complainant it appears some of Ops. have executed a document on stamp paper of Rs.100/- as money receipt on 07.02.2022 stating that they have received a sum of Rs.49,00,000/- from Prasun Ghosh proprietor of Usha Tea house for their business of tea and will pay the amount in 90 days and in default they will be liable to face all consequences.

 

 

 

                             Considering these allegations this commission is of the view that the allegations raised are civil in nature for not returning the amount taken for business purpose. There appears no relation for consumer and consumer disputes, so this complaint does not fall within the purview of C.P. Act.

 

                             Hence it is ordered that Consumer complaint no. 91 of 2022 is  not admitted and stands rejected.
