Final Order / Judgement

Order No. 03

Today is fixed for appearance of the parties.

The complainant no. 1 namely Utpal Pal and both the Ops are present alongwith their Ld. Advocates. Complainant No. 2 Shibani Pal happens to be the wife of complainant no. 1 Utpal Pal.

It is submitted by the Ld. Advocate of both that the matter has been patched up out of Court and the grievance of the complainants has been met up. According to them, the complainants want the dismissal of this case for non-prosecution.

One application seeking dismissal of the case is also filed by the complainants. On being asked the complainants submit that amicable settlement has been already arrived at, for which he wants to back out at this stage.

On being satisfied with the story of compromise as settled by the parties and as reflected in the compromise petition we find reason to say that this is a fit case for passing order as to disposal of this case.

Hence, it is ordered that the case be and the same is dismissed for non-prosecution and accordingly disposed of.

Let a plain copy be given to the parties free of cost as per CPR.
