Heard Mr. U.J Saikia, learned counsel, appearing for the petitioner in the Misc case for condonation of delay. Mr D. Bordoloi has entered appearance on behalf of the respondent without vakalatnama, but Mr. Bordoloi has assured  that he will be appearing  in the connected appeal also if the prayer for  condonation is allowed , therefore, he prays that he given some time to file vakalatnama.

                          This is an application for condonation of delay of 52 days in preferring the connected appeal. We have perused the grounds/explanation given in para 4,5 and 6 and we are satisfied that the petitioner  was prevented from filing  the connected appeal in time. Accordingly , the delay of 52 days is hereby condoned. Misc case stands disposed.

                           In view of the order passed today in this Misc case, Registry shall allot a number to the pending appeal and the same shall be listed on 01-11-2013.
