Hon’ble Mr. Ajeya Matilal, Presiding Member

          None appears for either of the parties.

          It appears from order dt. 16.02.2203 in First Appeal No. 218 of 2017 that the Hon’ble NCDRC set aside the impugned order and it was remanded back to this Commission for fresh decision after giving reasonable opportunity to the petition who appeared and filed his reply/ W.V before the State Commission within the time granted by the Commission.

          It was directed by the Hon’ble NCDRC to dispose of the matter preferably within 3 months. In the aforesaid order the Hon’ble NCDRC directed the parties to appear before this Commission on 03.05.2023. But on that day the complainant did not appear but the OP no. 1 appeared through his Advocate by filing fresh power. On subsequent day i.e. on 06.06.2023 the Ld. Advocate for OP no. 1 was present. But the complainant was absent without any steps.

          So, it appears that in spite of giving opportunity by the Hon’ble NCDRC, the complainant did not appear on 03.05.2023 or on 06.06.2023.

          Today is also neither of the parties is present. So, it appears that the complainant has lost his interest to proceed with the case and the case being no. CC/380/2014 is disposed of for non compliance of the order passed by the Hon’ble NCDRC because the complainant did not appear on 03.05.2023. There shall be no order as to the costs.
