Mr. S. K. Behara, learned counsel, appearing for the appellant along with Sri Partha Bhattacharjee, respondent No. 1 (complainant) appearing in person are present.
A joint compromise application signed and verified supported by an affidavit jointly by the parties to this appeal is filed. The contents of the application are reproduced here-in-below.
That the applicant/appellant beg to state that the competent authority of the appellant insurance company has accepted the proposal in its letter and spirit to settle the said matter and as such a compromise has been reached between the parties for settlement of the case at Rs. 2,40,000/- (Rupees two lakh forty thousand only). There is no threat or any force from the appellants/claimants to withdraw from the instant appeal.
That the petitioner begs to state that since both the parties have come to an amicable settlement of Rs. 2,40,000/- (Rupees two lakh forth thousand only) the same amount will be deposited before the Registry of this Hon’ble Commission by O.P. 1 insurance company after the order is passed in this joint compromise petition.
In view of the contention refereed here-in-above, this appeal stands disposed of as per terms of compromise settlement arrived between the parties to this appeal as referred here-in-above.
As per the terms of the settlement, the appellant insurance company shall deposit the amount of Rs. 2,40,000/- (Rupees two lakh forty thousand) only within a period of four weeks from today in the Registry of this Commission where after, the said amount shall be delivered to Sri Partha Bhattacharjee respondent No. 1(complainant) by the Registry.
Statutory amount deposited by the appellant shall be returned to the appellant on proper identification.
