Heard Mr.T.R.Sarma, learned counsel appearing for the petitioner in the Misc Case No.46/2012. Also heard Mr. U.J.Saikia,learned counsel appearing for the respondent nos 1 and 2.

               This Misc case is filed for condonation of delay of 49 days in filing the connected appeal. An objection in the form of an affidavit is filed by the respondents nos 1 and 2 opposing the  prayer for condonation of delay.

                We have gone through the explanation given in the application for delay. The explanation given  does not impress us  and we cannot consider the explanation given in the  condonation  petitione as satisfactory explanation. However, considering the nature of the issue involved in the connected appeal, we have decided to condone the delay subject to payment of Rs.2000/- to the respondents. Accordingly, the delay of 49 days is hereby condoned.

              The Misc case stands disposed.

               In view of the above, Registry shall allot a number to the pending appeal and same shall be listed for admission on 10-09-2012.
