Learned counsel for the appellants is present.

A memo has been filed by the learned counsel for the appellants along with letter No. 1261 DESI dated 06.02.2019 from the Director of Employees State Insurance Scheme, Odisha, Bhubaneswar to the learned Additional Standing counsel who is appearing on behalf of the appellants. The memo reads as follows:-

“As per letter No.1261, dtd.06.02.2019 of Director of Employees State Insurance Scheme, Odisha, Bhubaneswar, the appellants do not want to proceed with the appeal because in the letter dated. 04.02.2019 of Joint Secretary to Govt. requested the State Counsel to withdraw the aforesaid appeal. In view of the said facts the appellants do not want to proceed with the appeal and accordingly your honour may graciously be pleased to permit the appellants to withdraw  the appeal.”

Learned counsel for the appellants submits that in view of the instruction imparted by the appellants, the appellants may be permitted to withdraw the appeal.

In view of the submissions made by the learned counsel for the appellants, the appeal is disposed of as withdrawn.
