None for the appellant. Mr. R. K. Jain, learned counsel, for the respondent No. 2 along with Mr. A. K. Choudhury, learned counsel, for the respondent No. 1 are present. Vide order dated 14-09-2023 the conducting counsel for the appellant was directed to trace out the address of the partners of Anamika Motors and send the notice accordingly through the learned District & Session Judge, Jorhat, requesting to serve the notice on the partners of Anamika Motors. But no such steps were taken.

                        Today as there is no representation on behalf of the appellant matter stands dismissed for default.

                        Statutory amount of Rs. 25,000/-deposited by the appellant vide D.D. No. 685988 dated 20-10-2014 shall be returned to the appellant or their authorized agent on proper identification.
