Today is fixed for hearing of this M.A. case. Ld. Advocates of both sides are found present. In this M.A. case the O.ps. have filed an application under Order 22 Rule 4 C.P.C. on account of the death of O.p. no.2-Biswanath Das.

Heard both sides. Considered submission.

Perused the M.A. application.

It is admitted fact that there is no locus standi of the O.ps. to file such application under Order 22 Rule 4 C.P.C. on account of death of O.p. no.2. Such type of application must be filed by complainant side.

In view of such position, this M.A. application is dismissed on contest. No order is passed as to cost.
