Final Order / Judgement

This case record is placed before the Ld. Judges of National Lok Adalat which is held today at the Court Room of  D.C.D.R.C., Howrah.

Both parties & their Ld. Lawyers are found present.

                In course of discussion it is revealed that the parties of this case have entered into amicable settlement and to that effect one joint compromise petition has been filed on 01.03.2024 before the D.C.D.R.C., Howrah.  It is agreed by the parties that the complainant shall hand over Flat No. 302 which is situated at 3rd floor of  the Apartment to the OP (Promoter / Developer) and instead of that the complainant is getting the flat  being No. 201 at the 2nd floor.  It is also agreed between the parties that the Promoter / Developer shall pay Rs. 9,50,000/- within the month of May, 2024 to the complainant.    

The Promoter / Developer  (OP of this Case) has already  issued two  cheques  bearing Nos. 000385 dt. 03.05.2024 & 000386 dt. 09.05.2024 both cheques are of Bank of Baroda, Howrah Branch.  The complainant has already received the said cheques.

Ld. Judges of National Lok Adalat  after making scrutiny  of the joint compromise petition finds that the terms and conditions  described in the said joint compromise  petition are found satisfactory, so it can be accepted and on the basis of the said joint compromise petition  the disputes of this case can be settled .

In the light of the observation made above it is accordingly,

ORDERED

That this Complaint Case No. 215/2022 be and the same is amicably settled in between the parties. Let the joint compromise petition be made a part of this order. The complainant is given liberty to execute this award in the event of failure of the OP to comply with the direction given in this order as well as in the terms & conditions described in the joint compromise petition.

The parties of this case are entitled to get a free certified copy of this final order as early as possible.

This final order shall be uploaded in the official website of this District Commission immediately.
