ORDER

The opposite party who is in person submits that he ahs been appointed as Administrator by superseding the society and further states that there is no assets either moveable or immoveable in the account of the society and until they recover money from other defaulter who have mis-appropriated, they have no funds to pay to the complainant. However, he concedes that the society is due to the complainant a sum of Rs.20,350/- and further submits that by recovering the amount they will pay the claim of the complainant. The learned counsel representing the complainant who is present and after hearing the submission of the opposite party finding no alternative submitted for passing a suitable order with a direction to the opposite party to pay back the complainant’s money after recovery. With this, we pass the following order: 1. The complaint is allowed. 2. The opposite party shall initiate early action for recovery of the amount from the defaulter and to arrange for payment to the complainant. 3. The opposite party is directed to pay Rs.20,350/- with interest at 12% p.a. from 01.08.2005 till the date of payment. 4. The opposite party shall also pay cost of Rs.1,000/. Give a copy of this order to both the parties according to Rules.
