JUDGMENT
The facts of the complaint in brief is that, the complainant has ordered for Mango, Coconut tree and Lemon tree to plant on his garden. The complainant advanced Rs.5,000/- to the op for supply of plants Vide receipt No.896 dtd.15.05.2014. the advanced amount to the op on 15.05.2014 and the op agreed to deliver the plants to the complainant on 23.05.2014 without fail. But several approaches of the complainant failed. The op could not delivered the plants or not returned the paid advance amount. The O.p failed to deliver the above plants and hence finding no other option the complainant approach this forum and prayed to direct the O.p to refund the cost of Rs.5,000/- and award compensation of Rs.1,500/-towards mental agony . Hence, this complaint.
On being noticed, the Op failed to file counter before this forum as such the proceeding was set exparte against them.
Heard and perused the complaint petition and documents filed by the complainant and we accept the grievance of the complainant. The Complainant argued that the O.p have received the amount of Rs.5.000/ from the complainant towards supply of plants as an advance. But the op not delivered the plants nor returned the above amount to the complainant and claimed that the O.p caused deficiency in service and deprived of the complainant of enjoyment since the date of its purchase which caused mental agony and harassment to the complainant.

Now we have to see whether there was any negligence of the Op in providing after sale service to the complainant as alleged ?
Hence, in our view the complainant has right to claim compensation to meet his mental agony, financial loss. Hence, it is ordered.
ORDER
The opposite party is directed to refund the advance amount of Rs.5,000and pay compensation of Rs.2,000/- for mental agony undergone by the complainant and cost of Rs.500/- . Further, we direct the Op to pay the aforesaid award amount within one month from the date of receipt of this order, failing which the O.P are liable to pay interest @ 12% p.a. on the above awarded amount till the date of payment. Accordingly the complaint is allowed.
