JUDGMENT
The present dispute arises out of the complaint petition filed by the above named complainant alleging deficiency in service against afore mentioned O.Ps for non delivery of the Video Albums and photograpahs. The brief facts of the case has summarised here under.
That during the month of May, 2015 the complainant have photos and video on the occasion of his younger brother’s marriage to be solemnized on 27th. May, 2015. The complainant contacted the O.P for taking photograph of the marriage evens to which the O.P. had agreed to render his service for valuable consideration of Rs. 20,000/-. The complainant had paid an advance a sum of Rs.2,001/- to the O.P. as scheduled the O.P. attended the marriage and took photographs and video graphs of the entire marriage event including the marriage dinner event. On completion of the photograph and videograph of the events the O.P. took a sum of Rs. 10,000/- for his service and balance charges assured him to deliver all the photograph and videograph of the marriage event within one month and balance amount of Rs.8,000/-would be paid to him in the event of his delivery of the marriage photographs and videograph. Inspite of repeated claims made by the complainant the O.P. failed to discharge his services for which the amount was paid to him. Hence this case. The complainant prays the forum direct the O.P to deliver the video albums and photographs of his brother and such other relief as the hon’ble forum deems fit and proper for the best interest of justice.
On being noticed the O.P. appeared through their learned counsel and took adjournments. Then the O.Ps neither entering in to appear before the forum nor filed their written version inspite of more than 5 adjournments has been given to them. Complainant consequently filed his memo and prayer to set exparte of the O.Ps. Observing lapses of around 11 months for which the objectives of the legislature of the C.P. Act going to be destroyed to the prejudice of the interest of the complainant. Hence after hearing the counsel for the complainant set the case exparte against the O.Ps. The action of the O.Ps is against the principles of natural justice as envisaged under section 13(2) (b)(ii) of the Act. Hence the O.P. set exparte as the statutory period for filing of written version was over to close the case with in the time frame permitted by the C.P. Act.
Heard from the complainant. Perused the complaint petition, documents filed by the complainant.
FINDINGS.
During the exparte hearing the complainant examined himself and proved the payment of the money to the O.P. towards deliver of the Video, albums and photographs. The complainant also argued due to non deliver of the photographs he suffered a lot of mental agony. The complainant prays the forum as the O.Ps not heard any grievance of the complainant till date so the O.Ps be directed to deliver of the Video, albums and photographs of his brother.
In the absence of any denial by way of written version from the side of the O.Ps. it is presumed that the allegations levelled against the O.Ps. deemed to have been proved. The complainant had paid Rs.12,000/- for the good service as per assurance which intended with the O.P and the said payment is made for the consideration for the said service. When the O.Ps have failed to give such service as per assurance for which the O.Ps have received the amount. It is deemed that the O.Ps were callous to the allegations and it amounts to deficiency of service.
Hence to meet the ends of justice, the following order is passed.
ORDER.
In the resultant the complaint petition is allowed in part on exparte against the O.P
The O.P is ordered to deliver of the Video, albums and photographs to the complainant inter alia to Pay Rs. -6,000/- towards compensation for mental agony and litigation expenses.
The O.P is ordered to comply the above direction within 45 days from the date of receipt of this order failing which to refund the deposited amount a sum of Rs.12,000/- along with interest @Rs. 9% per annum from the date of filing i.e. on Dt. 14.12.2016 till realization. Serve the copies of the order to the parties.
