           Both the Dhr and Jdr filed Hazira. Heard both sides. Perused the materials on record.

          It is evident from the record that this execution case was started in 2010 as per the judgment of this District Commission but subsequently there is a judgment of the S.C.D.R.C. in appeal by which the judgment of this District Commission was set aside and fresh directions were given.

          In terms of the Appellate Commission judgment the Jdr filed a petition that he is ready and very much eager to comply the order of Hon’ble  Appellate Commission for which both parties are to make certain compliance.

          Therefore, since the order of the Appellate State Commission is now to be complied with this execution case is to be disposed of with direction that fresh execution case be started being E.A. /74/2022 for compliance with the judgment of the Appellate State Commission.

Hence,

It is Ordered

          That this case is disposed of. Start  E.A./74 / 2022 with a copy of this order along with copy of judgment of Appellate Commission.

          Fixing by      5/1 /23  for compliance.
