ORDER

No. 5/14.05.2010.

 

HON’BLE JUSTICE SRI A. CHAKRABARTI, PRESIDENT.

 

Appellant through Mr. S. K. Das, the Ld. Advocate, Respondent No. 1 through Mr. Badhisatta Dutta, the Ld. Advocate and Respondent No. 2 through Mrs. Koyeli Koyeli Mukhopadhyay, the Ld. Advocate are present.  In terms of the settlement arrived at during the hearing on 06.05.2010 the amount mentioned in Serial No. 1 in the ordering portion of the impugned order dated 06.01.2010 being Rs.36,361/- has been paid by Bank Draft 941432 dated 13.05.2010 and cost of Rs.2,000/- also has been paid by Bank Draft No. 941433 dated 13.05.2010.  The Bank Drafts have been duly handed over to the Ld. Advocate for the Respondent No. 1.  It is agreed by the Appellant that a sum of Rs.258/- still lying due will be paid to LIC by Appellant within a period two weeks from today.  The Respondent No. 1 undertakes to submit an appropriate declaration of good health to the LIC in the concerned department within a period of two weeks.  With the aforesaid it is agreed amongst parties there will be no other claim for either of the parties in respect of the subject matter of the dispute of the present complaint.    The appeal is, therefore, disposed of and the impugned order also stands modified in terms of the settlement as recorded hereinabove.
