D/hr. is absent without steps. It appears from the case record that D/hr. and J/dr. are absent since 27.02.2019. After perusing the case record it appears that an appeal is pending before Hon’ble State Commission being no. A/336/2017. Last reference of order no. 3 dt. 11.1.2018 of Hon’ble State Commission, WB filed by the J/dr. Since then they are absent without steps and no status of Hon’ble State Commission files during 2 or 3 years. So, this Commission vide its order dt. 20.2.2020 directed the D/hr. to file a show cause as to why thecae shall not be dismissed for default. Since then D/hr. is absent without steps and failed to file the order of Hon’ble State Commission in appeal case.

So, this Commission is in the opinion that the J/dr. is not interested to proceed with the case as such the execution appeal being no. 27 of 2016 is deserved to be dismissed for non prosecution.

Hence ordered that the execution E.A. 57/2016 be and the same is dismissed due to non prosecution.
