            Mr. S. Sancheti appears for the revision petitioner. The respondent Mr. Koushik Ranjan Das is present in person.

            This revision petition is filed against the impugned order dated 8-11-2013 passed in Consumer Case No. 47/13 and order dated 5-3-2014 passed in Misc Case No. 2/2014 arising out of CPC No. 47/2013 by the District Forum, Kamrup,

Perused the revision petition and heard both the parties. The learned District Forum wanted to proceed ex-parte as written statement was not submitted within 90 days by the revision petitioner/opposite party. At the same time, we find that the advocate engaged by the  revision petitioner/opposite party in C.P.C. Case No. 47/13 also withdrew the vakalatnama.

After considering the certified copy of the order sheets and hearing the learned counsel for the revision petitioner we find that there is a good case to go on for trial in the original Forum.

The respondent Mr. K. R. Das has no objection in allowing the revision petition, if he is compensated adequately. Learned counsel appearing for the revision petitioner has agreed to pay some compensation to the respondent/complainant.

Considering the above and hearing the parties, we allow this revision petition on payment of Rs. 5000/- to the respondent/complainant by the revision petitioner. The above amount will be paid by the revision petitioner in the District Forum. Upon receipt of that amount, the District Forum will proceed with the case by allowing the revision petitioner/opposite party in the complaint case, to submit written statement.

The impugned orders are hereby set-aside and the revision petition is allowed accordingly.

Fix 26-6-2014 for appearance of the parties before the District Forum.
