On the prayer of both sides the case is taken up for final disposal after hearing argument from both sides.
The Complainant’s case is that he contacted with O.P., a professional Photographer and Proprietor of Anjali Studio, for taking video and still photographs on the occasion of Wedding Ceremony of his son and accordingly he paid Rs.18,000/- in advance to the O.P. out of Rs.25,000/- . Ultimately O.P. could not deliver the video and still photographs in time and so the balance payment was withheld. The Complainant has approached this Commission for appropriate relief.
In the written version the O.P. has contended that he could not deliver the video and still photographs to the Complainant as full payment was not made.

-: Decision with reasons :-
Having regard to the facts of the case, submission, contention and documents on both sides the Commission finds that there was a contract between the parties at Rs.31,000/- in all for photography charges on the marriage ceremony of the Complainant’s son but due to unavoidable circumstances and misunderstanding between the parties the Complainant could not get the delivery of the photographs in time on payment of advance money of Rs.18,000/-. At the time of hearing the O.P. is present with the video and still photographs for delivery to the Complainant on payment of the contractual amount.
As agreed upon by and between the parties the Complainant has paid Rs.13,000/- in all to the O.P. today and got the delivery of the complete photography in good condition as handed over by the O.P. to the Complainant in Pen drive device after acknowledgement of the payment.
Accordingly it is ordered…..
That the case is disposed of on contest on full settlement as above.
Both parties be supplied copy of this order free of cost.
