A memo of compromise signed by both parties and their counsel is filed. The terms of compromise are read over and explained to both parties. The terms of compromise are recorded as follows:
“a) That the respondent/Opp.party has agreed to pay an amount of Rs.6,50,000/- towards full and final settlement in full satisfaction of the order of the Hon’ble State Commission, dated 18-7-2005 and that the petitioner/complainant has agreed for the same and accepted to receive Rs.6,50,000/- towards the full and final satisfaction of the order of the Hon’ble State Commission, dated 18-7-2005.
b) In view of the said compromise between the parties and as per the compromise settlement terms, the Opp.party has paid an amount of Rs.2,00,000/- (Rupees two lakhs only) to the complainant on 20-1-2008 and the complainant hereby admits and acknowledged the receipt of the said amount.
c) That the Opp.party has paid an amount of Rs.1,50,000/- on 25-4-2008 and the complainant hereby admits and acknowledged the receipt of the said amount.
d) That the Opp.party further has also paid a sum of Rs.2,00,000/- on 5-9-2008 to the complainant and that the complainant hereby admits and acknowledged the receipt of the said amount.
e) That the complainant is at liberty to withdraw the amount of Rs.1,00,000/- (Rupees one lakh only) deposited by the Opp.party in C.D.No.83/2002 which is in deposit and the Opp.party hereby conveys his no objection for withdrawal of the said amount by the complainant.
f) Thereby, the Opp.party completed the payment of the settled amount of Rs.6,50,000/- towards full and final settlement of the order of the State Commission, dated 18-7-2005. Since the complainant accepted the said amounts towards full and final settlement, the complainant does not have any further grievance against the Opp. Party in so far as the present subject matter is concerned.
g) The Opp.party is at liberty to withdraw the statutory deposit of Rs.35,000/- made by him before Hon’ble National Commission in FA.No.358/2005 and that the complainant hereby conveys their no objection for withdrawal of the said amount by the Opp.Party.
h) Hence, the P.P.No.46/2005 in C.D.No.83/2002 may be pleased to be closed as settled out of the court towards the full and final satisfaction of the complainant in accordance with the order, dated 18-7-2005.”
The P.P. is disposed of as per the terms of compromise.
