Order No.  7  dt.  03/07/2019 

           The complainant filed this case praying for an order in his favour so that he can be provided with a car parking space on the ground floor of the proposed G+4 storied building at KMC premises no.20B, Satchasipara Road, P.S. Cossipore, Kolkata-2. Ld. lawyer for the complainant was asked at the time of admission of hearing of this case whether only for having the claim of the car parking space is maintainable, whenever the complainant failed to produce any document that he entered into an agreement with o.ps. for having a flat in the said premises along with a car parking space to which the complainant could not submit any judgment in respect of his case. The complainant was given time to find out any judgment in support of his case. Today the complainant has filed a judgment and on perusal of the judgment we find that the moot point raised by this Forum does not cover the principle of the judgment as pronounced by Hon’ble Supreme Court. Since the complainant filed this case simpliciter for car parking space, therefore, we hold that the case filed by the complainant is not maintainable in this Forum.

            Hence, ordered,

            That the case is not maintainable and the same is dismissed in limini.
