| ORDER | ORDER NO. 7 DT. 12.12.13 HON'BLE JUSTICE MR. KALIDAS MUKHERJEE, PRESIDENT Ld. Advocates for the Appellants and the Respondent No. 1 are present. Respondent No. 2 is present in person and files BNA. Ld. Advocate for the Appellants submits that even after necessary correspondences with the Appellant, no instruction is received by him in connection with the Appeal and necessary orders may be passed. The application for condonation of delay was earlier allowed, vide Order No. 5 dt. 12.9.13, subject to payment of cost of Rs. 2,000/- by the Appellants to the Respondent/ Complainant by 4.12.13. On 4.12.13 on the prayer of the Ld. Advocate for the Appellants the matter was fixed today for payment of cost as a last chance. In view of the submission made by the Ld. Advocate for the Appellant, we are not inclined to extend the time-limit for payment of cost. Under the circumstances, the Appeal being time-barred stands dismissed. | |
