Misc Case no. 695 of 2018

       Learned counsel fo rthe parties are present. Learned counsel for the appellant/petitioner submits that in spite of repeate communications, the appeallant bank has not imparated any instruction with regard to compliance of order 18.12.2018 for payment of cost of Rs.15,000/- at the condition for condonation of delay in filing of appeal. A memo to that effect is filed.

       It appears that by order dt. 18.12.2018 appellant was directed to pay cost on 22.01.2019, when the matter was adjourned on the request of appellant/petitioner for payment of cost on 19.02.2019. On 19.02.2019 also on the basis of self-same prayer, the case was adjourned to today.

      In above circumstances and in view of submission of a memo filed by the learned counsel for the appellant, It is presumed that the appellant is not interested to pay the cost and to pursue the appeal. Accordingly, the prayer for condonation of delay stands rejected. The Misc. Case id dismissed.
