Heard Mr. K.K. Bhatta, learned counsel, appearing for the petitioner. Office note dated 16-6-2014 indicates that notice upon the respondent has already been served but none appears for the respondent.

            This is an application for condonation of delay of 99 days in preferring the connected appeal.  We have gone through the grounds given in para 3 and 4 of the application, explaining therein that as to how the petitioner was prevented from filing the connected appeal. We are satisfied with the explanation. Accordingly, the delay of 99 days is hereby condoned.

            Misc Case stands disposed.
