Today is fixed for admission hearing.
On 28.09.2021 it was also fixed for admission hearing. On the said date this Ld. Commission was pleased to pass an order directing the complainant to deposit a sum of Rs. 3,65,596/- with this Ld. Commission by way of Demand Draft by 30.09.2021. It was also observed in the order no. 1 that the abovementioned amount is still payable to the Op for performance of the complainant’s part of the contract.
But today none is present on behalf of the complainant, the amount is not deposited as per direction of the Ld. Commission dt. 28.09.2021.
This complaint was filed by the complainant on 09.09.2021 as per settled Law the admissibility of the complaint shall ordinarily be determined within 21 dyas from the date of filing of this complaint.
Today without taking any steps compliant remained absent. Under this situation we have no option but to dismiss the complaint.
Accordingly it is ordered that the Consumer Complaint being no. CC 260/2021 is hereby dismissed without being admitted. There is no order as to cost.
However the complainant is at liberty to approach before the competent Court for redressal of his grievance, if not barred otherwise.
The complainant is also at liberty to get return the copy of the complaint and the documents from the appropriate authority of this Commission as the complaint is not admitted. In this respect the complainant is further directed to submit a separate application praying for return of the abovementioned documents. The appropriate authority of this Commission is hereby directed to take necessary step upon receipt of the application from the complainant so that the complainant can get return of the aforementioned without any further delay.
Let plain copy be given to the parties free of cost, as per CPR.
