Today is fixed for hearing of the MA being No. 82/2021.
The Ld. Advocates on both sides are present. The application along with W/O are perused and the opportunity of being heard is given to both the Ld. Advocates.
The complainant has sought for refund of Rs. 2,87,000/- with interest from the date of payment along with compensation, litigation cost etc. on the ground that the aforesaid amount of Rs. 2,87,000/- was advanced by the complainant under an agreement to OP 1 i.e. Evanie Infrastructure Pvt. Ltd. The agreement was also signed by Evanie Infrastructure Pvt. Ltd. The flat sought to be purchased by the complainant was also due to be constructed by OP 1. All the main grievances are directed to OP 1.
OP 2 is attached to the customer care unit of OP 1 and her presence may not be necessary for arriving at just decision in this case.
Therefore, prayer for expansion of the name of OP 2 is allowed. The MA/82/2021 is thus disposed of.
Fix 04.02.2022 for filing questionnaire by the OP 1.
Let plain copy be given to the parties free of cost as per CPR.
