: COMMON ORDER :
Mr JUSTICE HULUVADI G RAMESH : PRESIDENT
01. These Review Petitions are filed under Section 50 of Consumer Protection Act 2019, to review the Order dated 24.07.2023 passed in Appeal Nos.117, 113, 116, 104, 95, 108, 109, 100, 101, 110, 115, 118, 98, 107, 106 and 102/2017 respectively. Since the case of the Petitioners in all these cases and that the Review Petitioner is common in all these cases, besides the grounds, allegations and facts involved in all these cases are also similar, they are taken up together for consideration.
02. Heard the learned Counsel for the Review Petitioner. Considering the nature of the case, issuance of the Notice to the Respondents in all the Petitions are dispensed with to avoid further delay and more than anything else, the age of the Petitioners and the vintage of the matters.
03. The prayer sought in these Review Applications is to modify the Order dated 24.07.2023 passed in Appeal Nos. 117, 113, 116, 104, 95, 108, 109, 100, 101, 110, 115, 118, 98, 107, 106 and 102/2017 respectively, arising out of the Order dated 07.01.2016 passed in Complaint Nos.102, 46, 101, 33, 26, 40, 42, 27, 29, 43, 48, 103, 24, 39, 37 and 31/2014 by the District Forum, Kalburgi.
04. This Commission on 24.07.2023 held that the Impugned Order passed by the District Forum is just and proper, for the reasons recorded therein and that it does not call for any interference. Hence, we did not find any grounds to review the order dated 24.07.2023 passed by this Commission for the grounds of Review Application under Section 50 of Consumer Protection Act 2019. If at all, the Appellant/Review Petitioner has already revised the entitled Monthly Pension of the Complainants by giving weightage of two years and also paid the consequential arrears to the Complainants/Respondents herein and contention of the Review Petitioner that there is no provision of extending of minimum assured benefits, both for past service and present service separately, the same has to be raised before the District Commission in Execution proceedings.
05. With the forgoing observations, RA No.135/2023 to 150/2023 stands disposed off.
06. Keep the Original of this Order in RA No.135/2013 and copy thereof, in rest of the Review Applications.
07. Send a copy of this Order to the District Commission as well as to the parties concerned, immediately.
