Ld. Counsel appearing for the Complainants is present and Complainant no. 1 namely Mr. Amar nath Das is also present in person.
OP namely Mr. Goutam Prasad Singh is present along with his Ld. Advocate.
It is pertinent to note that the rest Complainants i.e. Complainant no. 2 namely Mr. Shyama prasad Das, Complainant no. 3 namely Smt. Anima Dutta and Complainant no. 4 namely Smt. Swapna Das already endorsed their statement upon one stamp paper (non-Judicial paper) expressing categorically that on their behalf possession letter of the flat in question, handing over the documents, if any, of the said flat in question coupled with a sum of Rs. 2,75,000/- will receive from OP on behalf of them as well as on behalf of himself by the Complainant no. 1 namely Mr. Amar nath Das.
At this stage it is pertinent to note that OP already tendered one Account Payee post-dated cheque dt. 20.09.2023 bearing no. 408647 in favour of the Complainant no. 1 namely Mr. Amar nath Das amounting to Rs. 2,75,000/- drawn on IDBI Bank, Sinthi Branch and to that effect Complainant no. 1 on behalf of himself and on behalf of other Complainants acknowledges the said cheque for his receiving and issued one receipt to that effect which be kept with the record.
That apart it is candidly declared by Complainant no. 1 that he has already received the key of the flat in question on his behalf and on behalf of the other Complainants.
Today OP handed over the possession letter of the said flat in question to Complainant no. 1 and in turn Complainant no. 1 acknowledges the same by receiving for himself and on behalf of the other three Complainants and issued one receipt in connection with said possession letter which be kept with the record.
Parties including their Ld. Counsel agreed that OP already took all efforts for restoration of supply of drinking water in the flat in question and due to some pending works of the concerned Municipality supply of water in the flat in question including the premises as a whole is being disturbed.
Now, it has been settled that the moment concerned Municipality will complete their works relating to supply of drinking water in connection with supply of water in the concerned premises including in the flat in question, OP to ensure supply of drinking water in the flat in question of Complainants without any disturbance.
Accordingly, the instant case being no. CC/406/2021 is disposed of with full satisfaction.
Copies of this order be supplied to the parties.
