No. 1/08.06.2009.

Heard Mr. S. Dey, the Ld. Advocate for the Revision Petitioner.  The contention of the Revisionist is that attachment under Section 25(1) in execution of a final order is permissible.  In support of this contention he refers to the judgement in the case of Masarat Islam Soharwardy - vs. - Ashfaque Karim reported in I (2008) CPJ 414 (NC).  We have considered the said judgement and found that the said judgement also confirmed the view that in respect of execution case of a final order Section 25 (1) is not available.  Therefore, this contention of the Revisionist is not acceptable.  With regard to the other contention that the impugned order granted 40 weeks in installation of a lift, we do not find any such direction in the impugned order.  In such circumstances we do not find any of the contentions acceptable and, therefore, the revision is dismissed.
