Mr. B. Hazarika leaned counsel representing Mr. B. C. Pathak, conducting counsel on behalf of the appellant submits that he has the instruction from the BSNL to withdraw the appeal.

                 In view of the same, we allow and grant the leave to Mr. Hazarika to withdraw the appeal.

                 Accordingly, appeal  stands disposed of on withdrawal.

                 Send back the LCR to the concern learned  District Commission.

                 The statutory amount shall be disbursed by the registry either to the appellant subject to identification or authorized agent if any statutory amount deposited

                 Interim order if any is vacated.
