Shri Sudip Majumder- President-in-Charge.

Today is fixed for passing order. The complainant had already been filed an application dated 08/02/2024for amendment U/O 1 Rule 10(2) Readwith Section 151 of C.P.C.

The petition dated 08/02/2024 filed by the complainant for impleading  OP No. 1 (a) Prabir Das, 1(b) Sribi Das, 1(c) Abir Das all son of Late Shri Ekkari Das them in place of deceased OP No. 1 Sri Ekkari Das is taken up for hearing for treating the same as M.A Case No. 24/2024.

Heard Ld. Advocate for complainant.

 We find that the OP No. 1/ Sri Ekkari Das had died and the OP Nos. 1(a) to 1(e) being legal heirs of deceased praying for substituting them as the OP.

We find no impediment to allow the prayer.

Hence

            Ordered,

                        that the petition dated 08/02/2024 filed by OP No. 1 (a) Prabir Das, 1(b) Sribi Das, 1(c) Abir Das all son of Late Shri Ekkari Das for substituting them in place of deceased OP No. 1 Late Shri Ekkari Das i.e. M.A Case No. 24/2024 is allowed. No Cost.

Thus the M.A Case No. 24/2024 is disposed of.

Fix. 19/03/2024 for filing amended copy of the Complaint by the Complainant.

            Copy of this order be supplied to the parties each at free of cost.
