Both the parties are present. The Complainant files the Track Report from which it appears that the O.P. received the notice on 15/03/2023 but he filed the W/V i.e. on 11/05/2023.

It is well within the knowledge of everybody that the stipulated period for filing W/V within 30 days from the date of received notice which has already been over. So, the W/V has filed by the O.P. cannot be accepted.

Hence, the case do run ex-parte against the Opposite Party.

Fixing by 06/07/2023 for filing evidence-in-chief by the Complainant in ex-parte and BNA, if any, in the meantime.
