Heard both sides on the petition regarding maintainability filed by the O.P. Nos. 1 and 2.

Perused the petition and the objection and record and also the documents and case record. Considered all the materials thoroughly and the argument of both the parties.

It appears that there is mixed question of law and facts regarding prayer for non-maintainability which cannot be decided at this stage without evidence. Hence, the petition for non-maintainability of the case filed by the O.P. is rejected at this stage. This issue will be decided at the time of final disposal of the case.
